REAC is forever changing the rules—and inspectors cannot apply them consistently, especially when it comes to non-industry standard (NIS) repairs. Yet you’ll face significant penalties for UPCS non-compliance. And the heat is definitely on at the moment: REAC is set to revamp its 20-year-old scoring system!

REAC Inspectors are ill-equipped and inexperienced in recognizing NIS repairs, so it is vitally important for property owners, managers and maintenance staff to stay current on what information REAC is and is not imparting to its inspectors. REAC has substantial penalties for UPCS non-compliance and does not always follow its policies and its inspectors don’t apply the rules inconsistently, especially NIS rules. REAC, it seems, has overstepped its mandate by requiring inexperienced inspectors to make judgments on whether or not licensed tradesmen repair work is adequate and meets codes.

The NIS repair rules were forced on properties. Neither public comments, nor legal ruling were sought before the NIS rules were implemented. The fact is REAC Inspectors are not qualified to judge most NIS repairs – and you should be prepared for the consequences. They invariable misapply the NIS rules, so it is important to understand what they are looking for and the best way to avoid costly defects and file a successful appeal.
