The EEOC will require many firms to file additional wage and headcount data soon. These filings will expose your wage and hour data to statistical testing by the EEOC, OFCCP, and potentially private plaintiffs, via FOIA. The EEOC has proposed three sets of statistical tests for the initial screening of potentially hundreds or thousands of employee groups within a company. The statistical tests described by the EEOC are well-known, well-tested, but are less frequently used and not simple to do. However, they are available in on-line apps (EquiCalc), and you can gain a huge advantage by identifying, and potentially mitigating, any issues before the EEOC, OFCCP or private litigants inform you or your C-Suite of any problems.
