Documenting employee behavior and performance is critical because legally "if it's not documented, it never happened." The human resource function is fraught with legal landmines in every turn, and only documentation can help in minimizing the risks of regulatory lawsuits and penalties.

Managers may want to rush ahead with an employee termination but when asked about documentation, they have nothing to show except, “we’ve discussed the issue with the employee and told him/her about our decision.” But that statement won’t stand if the EEOC comes knocking at your door. The HR department is the one held accountable for EEOC penalties, expensive settlements or litigations.

Managers typically fail to document behavior or performance issues that lead up to termination. Some even wrongly think that they don’t need reason to fire an employee because they are an “At-Will” employer. That logic is really flawed and can cost your organization a lot of money. Without a robust employee performance documentation system, you are really inviting EEOC charges, expensive settlements and even litigation. Not properly documenting can hurt you in unemployment compensation disputes, workers’ compensation cases, and other legal matters. Good records, on the other hand, can mean the difference between winning and losing a lawsuit.
